Sosa has murder charges dismissed-Autopsy reveals baby was stillborn

After receiving autopsy results, prosecutors have dismissed a murder charge against Lillian Elizabeth Sosa, 18, but have charged her with abuse of a corpse.

Bond was set at $25,000. The new charge carries a sentencing range of one to two years.

Sosa, who is believed to be an illegal alien, was charged last month after giving birth in the bathroom of a Smithville restaurant and dumping the body in a trash can.

Sosa was originally charged with murder because prosecutors believed Sosa gave birth to a live baby and left the newborn in a trash can to die. However, autopsy results reveal the child was stillborn.

‘We recently got the autopsy back from Dr. Levy’s office and it was their opinion, and what they would testify to, that the child was never alive, therefore the murder case had to be dismissed,’ said assistant district attorney Bill Locke.

‘It was very traumatic for everyone involved to see this situation. Initially when the charges were brought, going by what we had to go on that night, I guess the indications were the baby might have breathed and been alive,’ Locke added. ‘Upon further investigation, it seems like the autopsy findings would be correct, that we don’t have anybody that would say the baby was alive.’
